1. Responsible for the treatment of your personal data

For the Company, treating your data in a legitimate way is a priority issue. This Privacy Notice complements any other simplified privacy notices that our organization has placed at your disposal and is supplementary in everything that does not expressly refer in such notices.

3. Purposes of processing personal data
The Responsible part collects your data for the following purposes:
- To register you as a client and / or supplier of our products and / or services.
- To create a profile of the owner. This profile will be used for the purposes that the same user gives consent.
- Process your requests, and therefore manage the relationship you want to establish with TL Pacifico S. de R.L. of C.V. or the one already established between you and the society itself.
- For administrative purposes in any way related to the performance of the relative contractual obligations, for the performance of the obligations of the law, such as, accounting or fiscal obligations.
- Follow up on requests that you made (client), whatever the reason, such as product and / or service information, quotes, and other concerns.
- Transfer your data, if required, to other companies in the corporate group, business partners and/or service providers.
- Guarantee the correct and adequate treatment.
4. Personal data that we collect
We collect your personal information directly when you provide it to us personally, by phone, through e-mail or through our website. The data that we obtain can be, among others, the following: name, address, telephone, e-mail, etc.
In accordance with what is established in Article 9 of the Federal Law of Protection of Personal Data in Possession of Private Parties, when the Responsible Party collects your data, your express consent will be required in order to process the data; therefore, we will request that you indicate whether or not you accept the treatment of the data, through the electronic mechanism that we have implemented for these purposes, or if applicable, provide us with this document duly signed.
5. Options and means to limit the use or disclosure of personal data
The mechanisms that were implemented to exercise these rights are through the presentation of the respective request to our Administration Department, by sending an e-mail (to the one previously indicated). You can obtain this request by sending an e-mail to the Personal Data Department.
6. Means to exercise the rights of access, rectification, cancellation or opposition
You have the right to access the personal data that we have and the details of their treatment, as well as to correct them if they are inaccurate or incomplete; cancel them when they are excessive or unnecessary for the purposes that were obtained or oppose to the treatment of your data for specific purposes.
The mechanisms that were implemented to exercise these rights are through the presentation of the respective request to our Administration Department, by sending an e-mail (to the one previously indicated). You can obtain this request by sending an e-mail to the Personal Data Department.
To exercise your rights, you must submit an application (“Request for Exercise of Rights ARCO”) to the Responsible, with the following information:
- Name and address;
- Personal Identification (IFE, Passport, Professional Certification or if you are from another country, Immigration Document);
- If another person wants to submit the application for you, he/ she will need a document proving the existence of the representation, i.e. public instrument or power of attorney signed before two witnesses, together with the identification of the holder and the legal representative (IFE Credential, Passport, Professional Certification, or in case of being of foreign nationality, immigration document):
- Clear and precise description of the personal data regarding which seeks to exercise any of the ARCO Rights, what is the right to exercise and the reasons why do you want to exercise it;
- Any document or information that proves that your personal data is owned by LCTPC;
- In case of requesting a rectification of your data, the modifications to be made will also be indicated and the documentation supporting your request will be provided (birth certificate and proof of your address - water or telephone bill).
The Responsible party will respond to your request by e-mail, within a term of 20 (twenty) business days, they will start to count on the date an acknowledgment of receipt is sent to you in response. If your request is approved the response will be sent via e-mail. TL Pacifico S. de R.L. of C.V. may request to be able to give you an answer, that you present for comparison at the address described above, original of the documents you sent along with your request, within 5 (five) business days following that request. If past this term you have not submitted the documents, your request will be filed and the Privacy Notice will continue in effect until a new application is submitted.
When the request is approved and the comparison checks out with respect to the personality and ownership of ARCO Rights, the terms to carry out the request will be the following:
- To access the data: within a period of 15 (fifteen) days counted from an affirmative response made by the Responsible party.
- For rectification of the data: within a term of 15 (fifteen) days counted from the affirmative response made by the Responsible party.
- For the cancellation or opposition of the data: a blockage will be made first, from the moment in which the required documentation was compared, where access to personal data will be restricted to any person until there is a response to the request whether affirmative or negative, in the first case within a term of 15 (fifteen) days counted from the affirmative answer made by the Responsible party, and in the second case the unblocking will be done to continue with the treatment.
The periods referred to in the preceding paragraphs may be extended once for an equal period if necessary and after notification by the Responsible party.
TL Pacifíco S. de R.L. de C.V. may deny the exercise of ARCO Rights, in the following cases:
- When you are not the owner of the personal data, or have not accredited the owner’s representation;
- When your personal data does not work in the database of the Responsible party;
- When the rights of a third party are injured;
- When there is a legal impediment or the resolution of a competent authority that restricts your ARCO Rights;
- In case of cancellation, when personal data is subject to treatment for prevention or for medical diagnosis or management of health services, or;
- When the rectification, cancellation or opposition has been previously made.
The Refusal may be partial, in that case, TL Pacifico S. de R.L. of C.V. will access, rectify, cancel or oppose in the pertinent part.
The exercise of “ARCO Rights” will be free, but if you repeat your request in a period less than 12 (twelve) months, the costs will be 3 (three) days of General Minimum Wage plus the Tax to the Added Value (IVA), unless there are substantial modifications to the Privacy Notice that motivates a new Request for the Exercise of ARCO Rights. You must cover the justified shipping costs or the cost of reproduction in copies or other formats.

7. Mechanisms and procedures for the owner, if applicable, revokes his consent at any time
At any time during the processing, you may revoke the consent you have given for the processing of your data, for this you must contact the data protection officer, where you will be informed of the procedure to be followed in order to revoke your consent.
8. Transfers of personal data within Mexico and abroad
We promise not to transfer your personal information to third parties without your consent, except for the exceptions provided in Article 37 of the Federal Law of Protection of Personal Data Held by Private Parties, as well as to make this transfer in the terms set by that law. In this sense, it is necessary to indicate whether or not you consent to the transfer of your data in the following space:

9. Implemented security measures
For the protection of your personal data we have implemented security measures of an administrative, physical and technical nature in order to avoid loss, misuse or alteration of your information.
When we communicate or share your information with third parties that provide us with a service, we require and verify that they have the necessary security measures to protect your personal data, prohibiting the use of your personal information for purposes other than those in charge; in the understanding that notwithstanding the foregoing, any breach by said third parties to the provisions of the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations is the exclusive responsibility of said third parties.
10. Modifications to the privacy notice
We reserve the right to make changes or updates to this privacy notice at any time.
These modifications will be available to the public through the following means:
- Visible ads in corporate offices;
- Triptychs or brochures available at corporate offices;

11. The right to promote the procedures for the protection of rights and the verification of the Institute
